The Osun State Governorship Tribunal’s ruling was overturned by the Court of Appeal in Abuja, on Friday, upholding Senator Ademola Adeleke’s election as the state’s new governor.

After the state’s governorship elections, an election petition tribunal removed Adeleke from office on the grounds that the senator had not received a majority of valid votes in the July 16 governorship elections.

The Court of Appeal, a three-member panel presided over by Justice Mohammed Shuaibu, overturned the tribunal’s decision in unanimity and ruled that Adeleke is the legitimate governor of Osun State.

The Appeal Court Panel overturned the tribunal’s ruling directing the withdrawal of Adeleke’s certificate of return and the issuance of Oyetola’s instead.

The panel upheld the issue of BVAS raised against Oyetola, stating that the Osun State tribunal was wrong to have said that there was over voting, a claim that only relied on the evidence by Oyetola and the APC, and as such, doesn’t prove their case in any way.

Justice Lawal, of the Appeal Court, Abuja also awarded N500, 000 cost against the All Progressive Congress, APC, and its candidate, Gboyega Oyetola.
